CHARLESTON, SC (WCSC) - A James Island man is accused of using a knife to attack an employee at a restaurant in downtown Charleston.

The Charleston Police Department arrested 26-year-old Herbert Joseph Butler on Sunday and charged him with second-degree assault and battery.

Butler's arrest stems from an incident early Saturday morning when police responded to an assault at Gilroy's Pizza Pub on 353 King St.

The victim, an employee at Gilroy's, said it all started when Butler was escorted out of the business due to his "level of intoxication." According to the victim, Butler was belligerent and used vulgar language.

The victim said Butler returned to the restaurant and was upset about being asked to leave earlier. Police say Butler then attempted to get into a physical altercation with the victim.

A police report states as the victim approached Butler to escort him off the property once again, Butler began to assault the victim.

Authorities say during the struggle, Butler used a kitchen knife to cut the victim. Officers reported that the victim sustained a minor cut to his left finger and forearm from the incident.

According to the victim, Butler then fled the scene in an SUV. The victim also told police he knew Butler because the suspect frequents the business.

A witness told police Butler instigated the incident, and saw the suspect swing a knife towards the victim.
