CHARLESTON COUNTY, SC (WCSC) - State Probation and Parole agents are looking 55 year old Terry Jonathan Smith.

Smith is wanted for a probation violation after being convicted of assault and battery of a high and aggravated nature against a minor.

"He was originally charged with lewd act and the lewd act was plead down to assault and battery of a high and aggravated nature," said Agent Mitchell Ray.

Ray said Smith could have gotten up to ten years in prison, but instead got five years probation with some credit for time served in jail.

However, he failed to report to his probation officer in October, 2011 and a warrant was issued for his arrest.

"We're charging him with failure to report, for making his whereabouts unknown. He failed to get sex offender counseling as ordered," Ray said.

"Given a tremendous break by the judicial system and he just basically threw everything out the window."

Smith stands 5'10" and weighs about 165 lbs.
